Lahore High Court declares two-finger virginity test for rape victims unconstitutional:

LAHORE: On Monday the High court of Lahore declared the two-finger test, the Virginity test for examination of sexual assault survivors. However, This was illegal in the constitution of Pakistan. Saying that there is no medical basis or forensic value of such tests in cases of sexual assault. Lahore High Court declares the two-finger virginity test for rape victims unconstitutional. Hence, Justice Ayesha Malik has announced the verdict on the petitions. 

Which has filed in March and June 2020 including PML-N MNA. Shaista Pervez Malik challenged the two-finger test was disrespectful and violated the women’s fundamental rights. Involving sexual harassment and violence against women is a high profile case. Therefore Pakistan has assumed to set up a new special court for this type of rape case within two couple of months.

However, they have requested to accept and investigate much more scientific methods for rape and sexual harassment. The verdict declared that the virginity test wounded the dignity of the female victim. These Virginity tests are against the female victims and these are come out on the basis of gender. Hence, this provoked the Article 25 constitution. The government should give advice to maintain proper protocols and guidelines with the proper practice for the care of victims of sexual violence. By having regular training and general awareness programs people can get understand that the virginity test has no clinical or forensic value.

Pakistan Ministry of Law and Justice:

During the proceedings, the Pakistan ministry of law and justice and health authorities have indicated that to end the practice. Pakistan made a decision they are going to create special courts for rape cases.

After that, the government of Punjab has given a call to stop the two-finger test. Based on the rules and protocols and guidelines for examing the females for sexual assault. Similarly, the government said to do an inspection. It must be done for both with a naked eye. The federal government has not approved the two-finger test.
